1. Operator and agreement

These Terms govern the ECLIPSE 9 website at https://www.eclipse9.com, operated by Chayangkoon Hanwang, contactable at admin@eclipse9.com (“we”, “us”, “our”). They cover available E9 ID accounts, novels, music, memberships, E9 Coins, Digital Cards, badges, Relics and related services.

We provide an opportunity to read and expressly accept the Terms during registration and relevant purchases. Additional product conditions must be disclosed before purchase. Mandatory consumer rights prevail over conflicting terms.

If you lack legal capacity to enter the relevant agreement, obtain the authorisation required from your parent or legal representative. Any age or territory restrictions displayed for content also apply.

2. Accounts and permitted access

Provide accurate information, protect your login credentials and notify us of suspected unauthorised access. Do not sell, rent, transfer or share accounts to transfer collection items, evade payment or bypass restrictions. Do not impersonate others, exploit bugs, interfere with security, use fraudulent payments or access content without permission.

3. Intellectual property and ownership

ECLIPSE 9 character artwork and original character expression, novels, written stories, dialogue, illustrations, lyrics, musical compositions, sound recordings, music videos, Digital Card artwork, graphics and other protected materials belong to their respective rights holders. We reserve the rights we own or are authorised to exercise, to the extent protected by applicable law.

Names, logos and branding may also be protected under applicable trademark or other laws. This statement does not assert that every name or mark is registered, that general ideas are exclusively owned, or that every AI-generated element necessarily qualifies for copyright protection.

A membership, coin purchase, chapter unlock or Digital Card grants only the personal-use access or display rights expressly described. It does not transfer copyright, ownership of a character, publishing rights, music rights or commercial exploitation rights.

Except as authorised below or allowed by applicable law, do not distribute entire chapters or books, reupload full tracks or videos as substitutes for official releases, distribute paid files, bypass access controls or remove rights-management notices. Nothing here removes statutory exceptions or limitations, including lawful criticism, quotation or other uses where applicable.

4. Non-commercial fan-content permission

We welcome non-commercial Fan Art, Fan Fiction, Cosplay, Fan Edits, Dance Covers, Song Covers and other creative fan works. No individual permission is required if all the following conditions are met:

1. The particular fan work is created and shared without commercial exploitation or income linked to that work.
2. Credit it as: “Fan content inspired by ECLIPSE 9 — Unofficial / Non-commercial.” Link to an official channel where reasonably possible.
3. Clearly identify it as unofficial. Do not imply endorsement, agency, sponsorship or official Canon status.
4. Use only what is reasonably needed for the fan work. Do not disclose paid or unreleased materials, provide original downloadable assets, or create a substitute for reading, listening to or buying official works.
5. Respect applicable law and third-party rights. Do not use the materials for fraud, unlawful harassment or false endorsements. Lawful criticism remains permitted.
6. Do not claim exclusive rights over our pre-existing elements or register them in Content ID or similar systems in a way that blocks legitimate rights holders or other authorised fan works.

This permission is non-exclusive and non-transferable and covers only rights we are entitled to license. It is not a sublicense of rights belonging to unrelated contributors, platforms or other rights holders.

Commercial uses requiring prior written permission

The following are outside the general fan permission:

• Selling prints, books, files, cards, clothing, merchandise or other products using ECLIPSE 9 materials.
• Paid commissions using those materials, even a single commission or a cost-recovery charge.
• Advertising revenue or creator-reward income attributable to the fan work, sponsorships, affiliate promotion, paid advertising or use to promote a business.
• Paywalls, paid memberships, paid downloads or admission charges, and tips or donations tied to producing, requesting or accessing that fan work.
• Commercial events, distribution through music distributors, or minting NFTs, tokens or other tradable assets from the materials.

Platform-inserted advertising that the creator has not elected to monetise and from which the creator receives no share is not treated as income under this permission. Unrelated monetised content elsewhere on the same account does not automatically disqualify a clearly separated, non-monetised fan work.

Credit alone is not commercial permission. Silence or lack of enforcement is not approval. Obtain written authorisation from an authorised rights holder before commercial use: admin@eclipse9.com. Statutory rights that do not require permission remain unaffected.

Music-specific conditions

You may use excerpts of released music in qualifying non-commercial fan works and make qualifying non-commercial Song Covers and Dance Covers, only to the extent of rights we can license. Do not reupload an entire or substantially entire original recording with only a still image, lyrics or minor edits as a replacement for the official track.

Composition, lyrics, master recordings and third-party samples may have different owners. This permission does not clear third-party rights or override platform rules, and it does not guarantee freedom from automated claims. Contact admin@eclipse9.com with the relevant link if a claim appears inconsistent with this permission.

Fan creators' original contributions

You retain rights that legally arise in your own new contributions, excluding underlying ECLIPSE 9 elements. These Terms do not give us blanket rights to sell your fan work or use it in paid advertising. We will obtain separate permission for such use.

If a work breaches these conditions, we may request correction or cessation proportionate to the issue. Future policy changes will state an effective date and reasonable treatment of existing works. A previously compliant work does not retrospectively become infringing merely because our policy changes.

5. Digital Cards: personal collection only — no resale or trading

A Digital Card is a personal, account-bound right to access and display a digital collectible within ECLIPSE 9, as described before acquisition. It does not transfer copyright and is not offered as an NFT, token, security or investment. We promise no future value, resale value or return.

Users must not buy from other users, resell, auction, trade, exchange, rent, pledge or otherwise deal in Digital Cards, whether for money, coins, goods, services or any other consideration, on or off the website.

Cards must not be transferred or gifted to another person. Selling or transferring an account to pass on cards is prohibited. Brokering transactions, operating secondary markets, selling screenshots or copied card files, and minting tradable assets from the cards or their images are also prohibited.

Acquiring a card from an authorised official ECLIPSE 9 channel under its published conditions is permitted. We do not operate a secondary market or cash-redemption service. This does not exclude a refund or remedy required by applicable law.

You may share authorised collection screenshots or approved preview images to show your collection non-commercially. Do not distribute original files, provide access to account entitlements or imply that viewers can acquire your card from you.

6. E9 Coins and chapter access

E9 Coins are internal credits redeemable only for specified ECLIPSE 9 services. They are not offered as deposits or investments. User-to-user sales, transfers and cash redemption are prohibited, except for legally required refunds or expressly applicable remedies.

Before purchase, we disclose the price, currency, taxes where applicable, coin quantity, bonus conditions, expiry and order of consumption. We do not use this document to set an undisclosed expiry or shorten purchased validity retrospectively in breach of applicable law.

Coins or entitlements are credited after payment is verified. Report discrepancies with the order reference. We may correct errors and fraudulent transactions with appropriate notice and an opportunity to dispute the decision. We will not remove legitimate paid entitlements arbitrarily.

A chapter unlock gives personal access for the scope and duration stated at checkout. It does not authorise redistribution or resale. Do not describe access as “permanent” or “lifetime” unless the product terms accurately explain that promise and its limits.

7. Memberships, renewals and pricing

The checkout specifies benefits, duration, total price, billing interval, renewal model and cancellation method. Recurring billing applies only when clearly disclosed and validly authorised. Cancellation must be reasonably accessible through admin@eclipse9.com, as well as any cancellation control supplied in your account.

Cancelling stops future renewals; access for the paid period and any refund depend on disclosed conditions and mandatory law. Price changes for future periods require appropriate advance notice and an opportunity to cancel before the new price is charged. A material reduction in existing paid benefits is subject to applicable remedies.

8. Payments, refunds and EU/EEA consumer rights

Report duplicate charges, missing delivery, incorrect entitlements or non-conforming digital products to admin@eclipse9.com with your order reference. We aim to provide an initial substantive response within seven business days, without extending any statutory deadline. Refund method, processing time and related coin adjustments will be explained.

Digital purchases are not automatically excluded from refunds in all circumstances. Mandatory rights relating to non-supply, lack of conformity, cancellation or unfair terms remain available.

Where EU/EEA distance-contract law applies, consumers generally have a 14-day withdrawal period, subject to applicable exceptions and national rules. For paid digital content not supplied on a tangible medium, loss of that right through immediate supply requires the legally required prior express consent, acknowledgement of the resulting loss of the withdrawal right, commencement of supply and contractual confirmation. Accepting these Terms alone is not that consent or acknowledgement.

We will provide the required pre-contract information and a withdrawal method at admin@eclipse9.com. Where the right exists, you may exercise it by an unequivocal statement; use of a model form is not compulsory. Refunds will follow applicable law, generally within 14 days after notification where that rule applies.

An ongoing membership, service or coin arrangement may require a different legal analysis from an individual digital-content download. We do not apply a single digital-content waiver to every product. If you request early performance of a service, any proportionate payment or loss of withdrawal rights is subject to the applicable legal conditions.

Information about functionality, compatibility, interoperability, access restrictions, duration and relevant updates will be provided where required before purchase. Statutory remedies for defective digital content or services remain unaffected by the non-transferability rules.

9. Suspension, complaints and appeals

We may warn, limit a feature, stop a suspect transaction or suspend an account where reasonably necessary to address a breach, fraud or security threat. The response must be proportionate. Urgent action may precede notice where justified, followed by an explanation where legally and practically possible.

You may challenge an action at admin@eclipse9.com. We will review the facts. Suspension does not automatically extinguish refunds, lawful balances or consumer rights. We do not impose automatic forfeiture of all paid value for every breach.

10. Service changes, closure and liability

We may maintain or improve the service with reasonable notice where practical. Material changes to paid services and discontinuation will be handled in accordance with applicable law, including relevant notice, termination and refund rights. We will explain how unused paid value and remaining access will be addressed if the service closes.

No provision excludes liability where exclusion is prohibited, including applicable liability for fraud, intentional misconduct or gross negligence. Nothing removes mandatory consumer remedies or makes us the final judge of whether you have a legal right.

11. Governing law and disputes

Thai law governs these Terms, subject to mandatory protections that apply to you. If you are a consumer habitually resident in an EU/EEA country and its mandatory consumer rules apply, this choice of law does not deprive you of those protections.

Courts with jurisdiction under applicable law may hear disputes. No exclusive Thai-court clause prevents a consumer from bringing proceedings in a court available under mandatory rules. We do not require waiver of regulator complaints or compulsory arbitration through these Terms.

12. Changes, language and contact

We publish the current version and effective date. Material changes will be notified appropriately in advance, with fresh acceptance where required. We will not use an update to unfairly remove accrued paid rights retrospectively.

Thai and English versions are intended to be consistent. A language discrepancy does not limit mandatory rights or permit misleading interpretations; contact us for clarification.
